Welcome to Dr. Rex ("Dr. Rex," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Dr. Rex website, applications, APIs, Discord integrations, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. You represent and warrant that you are at least thirteen (13) years of age, or the minimum age required by applicable law in your jurisdiction, and are legally capable of entering into this agreement.

2. Description of Service

Dr. Rex provides software services, applications, APIs, Discord integrations, automation tools, analytics, server management features, account management services, and related functionality. We reserve the right to modify, suspend, restrict, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

Certain features of the Service require authentication through Discord OAuth2 or other supported authentication providers. By using the Service, you authorize Dr. Rex to access and process information associated with your account, including but not limited to your Discord user ID, username, display name, avatar, server memberships, and permissions necessary for the operation of the Service.

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or unauthorized purpose;
  • Violate Discord's Terms of Service, Developer Policies, or Community Guidelines;
  • Attempt to gain unauthorized access to the Service, its servers, databases, or related systems;
  • Interfere with, disrupt, or impair the security, integrity, or performance of the Service;
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service;
  • Copy, reproduce, distribute, sell, lease, sublicense, or commercially exploit any portion of the Service without authorization;
  • Use the Service to harass, abuse, threaten, or harm others;
  • Upload, distribute, or transmit malicious code, malware, viruses, or other harmful software;
  • Circumvent any technical limitations, rate limits, or security measures implemented by the Service.

Violation of this section may result in immediate suspension or termination of your access to the Service.

5. Subscriptions, Payments, and Refunds

Certain features of the Service may require payment of subscription fees or other charges. By purchasing a subscription or paid service, you agree that:

  • Subscription fees may be charged on a recurring basis until canceled;
  • You authorize us and our payment processors to collect all applicable fees;
  • Subscription payments are non-refundable except where required by applicable law;
  • Cancellation of a subscription prevents future renewals but does not entitle you to refunds for previous billing periods;
  • We reserve the right to modify pricing and billing terms upon reasonable notice.

Failure to pay applicable fees may result in suspension or termination of access to paid features.

6. API Access and Usage

Dr. Rex may provide API keys, developer tools, and related services. You agree that:

  • API keys are confidential and must not be shared, transferred, sold, or sublicensed;
  • You are solely responsible for all activity conducted using your API credentials;
  • API usage may be subject to rate limits, quotas, and additional restrictions;
  • We reserve the right to suspend, revoke, or modify API access at any time.

Dr. Rex is not responsible for any damages resulting from unauthorized use, disclosure, or compromise of your API credentials.

7. Intellectual Property

The Service, including all software, source code, documentation, graphics, trademarks, logos, designs, and other content, is owned by Dr. Rex or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted by these Terms, no rights or licenses are granted to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, processing, and storage of information as described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DR. REX DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE AT ALL TIMES OR THAT IT WILL BE FREE OF ERRORS, DEFECTS, INTERRUPTIONS, OR SECURITY VULNERABILITIES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DR. REX, ITS OWNERS, OPERATORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL THE TOTAL LIABILITY OF DR. REX EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO DR. REX DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Dr. Rex, its owners, affiliates, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising from or related to your use of the Service, your violation of these Terms, your violation of applicable laws, or your infringement of any third-party rights.

12. Termination

We reserve the right, in our sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Service for any reason, including but not limited to violations of these Terms, abuse of the Service, security concerns, legal requirements, or operational reasons.

Upon termination, your right to access and use the Service will immediately cease.

13. Changes to These Terms

We reserve the right to modify or update these Terms at any time. Updated Terms will become effective upon publication. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

15. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
